House Democrats introduce article of impeachment against Trump and a resolution calling on Pence to invoke 25th Amendment and sack Trump Updated for 2021

Updated: February 28, 2021

House Democrats introduced a resolution on Monday requesting Vice President Mike Pence to invoke the 25th Amendment and remove President Donald J. Trump from power. A Republican House member from West Virginia objected, meaning the full House will now vote on the resolution at 9 a.m. on Tuesday.

The resolution gives Pence 24 hours to invoke the 25th Amendment or the House will move to impeach Trump.

House Democrats also introduced one article of impeachment against President Trump for “incitement of insurrection.”

They charged President Trump with inciting a mob of his supporters to carry out a violent attack on the U.S. Capitol on January 6 in a bid to overturn Joe Biden’s election victory.

The introduction of the resolution now sets in motion a vote early this week that will make Trump the only American President to be impeached twice.

The article of impeachment was co-authored by Reps. David Cicilline, (R-I), Ted Lieu (Calif.) and Jamie Raskin (Md.).

It states that Trump engaged in high crimes and misdemeanors by “willfully inciting violence against the Government of the United States.”

Speaker Nancy Pelosi had announced on Sunday that Democrats will bring articles of impeachment against President Donald Trump early this week to the House of Representatives floor.

Pelosi wrote in a letter to her caucus that Democrats will also introduce a resolution on Monday calling on Vice President Mike Pence to invoke the 25th Amendment to force Trump from power over the deadly riot at the U.S. Capitol on Wednesday.

“I want to call to your immediate attention the action to be taken tomorrow morning, when Majority Leader Hoyer will request Unanimous Consent to bring up the Raskin resolution. This resolution calls on the Vice President to convene and mobilize the Cabinet to activate the 25th Amendment to declare the President incapable of executing the duties of his office, after which the Vice President would immediately exercise powers as acting President.  The text of the resolution can be found here,” Pelosi wrote. “If we do not receive Unanimous Consent, this legislation is planned to be brought up on the Floor the following day. We are calling on the Vice President to respond within 24 hours. Next, we will proceed with bringing impeachment legislation to the Floor.”

Pelosi added that “In protecting our Constitution and our Democracy, we will act with urgency, because this President represents an imminent threat to both.”

“As the days go by, the horror of the ongoing assault on our democracy perpetrated by this President is intensified and so is the immediate need for action.”

If Trump is impeached again, he will be the only President in the United States to be impeached twice.

Trump’s impeachment is coming only days before the end of his term when he will be replaced by Joseph R. Biden Jr. on January 20, 2021.
