U.S. Condemns Disqualification Of Pan-democratic Lawmakers In Hong Kong

The Trump administration on Thursday condemned the disqualification by China of pan-democratic lawmakers in Hong Kong.

"Beijing’s onslaught against Hong Kong’s freedoms and liberties continues. The United States strongly condemns the “patriotism” resolution passed by the National People’s Congress Standing Committee on November 11, which disqualified four members of Hong Kong’s Legislative Council for exercising their mandates as lawmakers," U.S. Secretary of State Mike Pompeo said in a statement.

He added: "This resolution tramples on the rights of the people of Hong Kong to choose their elected representatives as guaranteed by the Basic Law and further exposes Beijing’s blatant disregard for its international commitments under the Sino-British Joint Declaration, a U.N.-registered treaty. Beijing has eliminated nearly all of Hong Kong’s promised autonomy, as it neuters democratic processes and legal traditions that have been the bedrock of Hong Kong’s stability and prosperity. Once again, the CCP’s twisted vision of patriotism is a pretext to stifle freedom and the call for democracy.

"The United States will continue to work with our allies and partners around the world to champion the rights and freedoms of the people of Hong Kong and call out Beijing's abject failure to honor its commitments. We will hold accountable the people responsible for these actions and policies that erode Hong Kong’s autonomy and freedoms. We stand with the disqualified pan-Democratic lawmakers, the pro-democracy lawmakers who resigned in protest, and the people of Hong Kong."

Beijing’s action marked a watershed moment, giving the Hong Kong government arbitrary power to remove any legislator whose views it dislikes, turning the semi-democratic Legislative Council, or LegCo, into a rubber-stamp body.

On November 11, 2020, China’s National People’s Congress Standing Committee (NPCSC) adopted a decision disqualifying Hong Kong legislators who “publicize or support independence,” “seek foreign interference,” or pursue “other activities that endanger national security.” Requiring adherence to these vague provisions contravenes the rule of law and violates the rights of legislators to freedom of expression and opinion.

Beijing’s decision followed a series of actions by the Beijing and Hong Kong governments since 2016 to gain full control over the LegCo by disqualifying pro-democracy activists from running for seats or unseating them after they were elected:

The LegCo was established by the British colonial government and had been semi-democratic since 1985. It has been an essential, high-profile platform for legislators to air their views, galvanize public opinion, monitor the government, and hold officials accountable. The removal of pro-democracy leaders from the LegCo not only weakens Hong Kong’s democracy movement. It will also mean that highly unpopular government policies – such as “Tomorrow Lantau,” which has significant environmental impact – are likely to pass with little opposition.

“Beijing is tearing down the last vestiges of its promise of democracy to the people in Hong Kong,” Wang said. “Now that Beijing has removed even the veneer of democratic rule and autonomy from Hong Kong, other governments should respond with concrete measures.”
